This PICS sets out the policies of Gammon Construction Limited and its group of companies ("Gammon" – email
address: hongkong@gammonconstruction.com; registered address: 22/F., Tower 1 and 2, The Quayside, 77 Hoi Bun Road,
Kwun Tong, Kowloon, Hong Kong) and your rights as data subject in relation to personal data collection, storage,
use, processing, transmission, provision, disclosure, and deletion by Gammon.
Compliance with Law
Gammon will comply with the requirements of the law.
Specific Purposes for
Collection and Processing of Personal Data
Gammon collects and processes your personal data for the following purposes:
- for responding to your enquiry and communication;
- for consideration of your work experience and suitability for the job
vacancies within Gammon as advertised on its website : www.gammonconstruction.com;
- for forming part of job candidates data base necessary for the operation
carried on by People and Culture of Gammon;
- for observing any legal, governmental or regulatory requirements of the
Hong Kong Special Administrative Region or other relevant jurisdiction including any disclosure or notification
requirements to which Gammon is subject;
- for human resource management purposes, including performance evaluation,
sickness and leave record keeping, and payment of salary;
- for medical and other benefit coverage for you and your family;
- for security and for prevention, detection and investigation of crime;
- for improving product/service quality;
- for evaluating and providing advice and/or recommendations to you regarding
the type of products and services requested by you;
- for verification of your identity for the purpose of providing you with
products, services or job opportunity requested by you;
- for any other purposes related to and/or in connection with and/or for the
furtherance of any of the above purposes.
Scope of Personal Data
The personal data collected or/and processed by Gammon may include, amongst others
- Name;
- Identity Card No/Passport No and copy;
- Occupation/Profession;
- Address;
- Telephone and fax numbers;
- E-mail address;
- Work experience;
- Education background;
- Professional qualification;
- Videos and images of individuals;
- Fingerprints and other biometric data;
- Information on your family;
- curriculum vitae;
- references;
- appraisal and disciplinary records;
- salary, pension and benefits details;
- medical , security and financial records; and
- bank account and tax details of employees (including potential employees ,
as applicable).
Collection of Personal
Data
Generally, we collect personal data from you in the, but not necessarily limited to the, following ways:
- When you apply for a job with us;
- When you access our website and enter your information;
- When you interact with any of our employees;
- When you request to purchase our products or services;
- When you respond to our request for additional personal data;
- When you ask to be included in our email or other mailing lists;
- When you request to be contacted;
- When you respond to our initiatives or promotions; and
- When your information has been submitted to us for any other reason.
All personal data will be collected on a voluntary, open and fair basis. Whilst you are entitled to refuse to
provide or withhold the disclosure or provision of any of the aforesaid personal data, incomplete disclosure may
prevent Gammon from conducting a complete assessment of your suitability for a particular position or shortlisting
you for an interview or from assisting you in your enquiry or communication.
Accuracy of Personal
Data
Gammon will take all practicable steps to ensure that the personal data so collected are accurate, having regard
to the purposes set out above. However, your efforts to provide accurate personal data in your resume or enquiry
or communication (if applicable) and thereafter to update Gammon of any change in your personal data will be
required to assist us in maintaining accurate personal data.
Your Rights
You as a data subject have the right:
- to know the PICS of Gammon.
- to request us to explain our personal information processing rules.
- to know whether Gammon holds any of your personal data and the extent of
the personal data being held by Gammon. You also have the right to request access to and obtain copies of such
data.
- to require us to correct and supplement your personal data held by Gammon
at any time.
- to ask for your personal data to be erased or destroyed where
- the purpose of our collection or processing has been achieved or cannot
be achieved, or it is no longer necessary to achieve the purpose;
- we cease to provide relevant products or services, or the retention
period has expired;
- you withdraw your consent for our collection and processing;
- we violate applicable laws or regulations, or violate the agreement
between us for the handling of the personal data;
- other circumstances stipulated by applicable laws or regulations apply;
However, your exercising of this erasure right will not affect the lawfulness of any processing carried out
before your request of erasure and we may not always be able to comply with your request of erasure for specific
legal reasons which will be notified to you if applicable at the time of your request. We may not be able to
provide certain products or services to you as a result and we will advise you if this is the case at the time
upon your request of erasure.
- to request that we provide copies of personal data you have provided to use
and in a format which will allow you to transfer the data to another organization for handling.
- in the event of your death, to allow your next of kin, for his/her own
lawful and legitimate interests, to exercise your rights of access, copy, correction, deletion, etc. However, by
agreeing to this PICS, you confirm that your next of kin or anyone else shall not exercise your rights to your
personal information.
- to request that we do not use your personal data to send you marketing
information.
- to request that decisions about you are not made solely by an automated
process.
- to request that we cease to process (or suspend processing) your personal
data.
- to withdraw your consent for our collection and processing of your personal
data (However, this will not affect the lawfulness of any processing carried out before you withdraw your
consent. If you withdraw your consent we may not be able to provide certain products or services to you. We will
advise you if this is the case at the time you withdraw your consent).
- to complain to us or the relevant authority about the way we use your
personal data. We would appreciate the chance to deal with your concerns by contacting us before you approach
the relevant authority, so please contact us in the first instance.
Where possible we will seek to comply with your request but we may not always be able to do so for specific legal
reasons which will be notified to you if applicable at the time of your request. All requests will be considered
without delay and within one month of receipt as far as possible. Occasionally it may take us longer than a month
if your request is particularly complex or you have made a number of requests. In such a case, we will notify you
and keep you updated.
Your personal data and other related or relevant data may be processed, kept, transferred or disclosed in and to
any country as we or any person who has obtained such data from us considers appropriate. Such data may also be
processed, kept, transferred or disclosed in accordance with the local practices and laws, rules and regulations
(including any governmental acts and orders) in such country.
Personal data provided by you and employees are only retained for as long as the purposes for which such data were
collected continue. We may retain the personal data for longer period in the event of a complaint or if we
reasonably believe there is a prospect of litigation in respect to our relationship with you.
Personal data of unsuccessful applicants for any positions within Gammon will be destroyed by Gammon after one
year from the respective dates of rejection of their applications. The unsuccessful applicants may request the
destruction of their personal data if they do not wish them to be used for future recruitment purposes.
In accordance with the law, Gammon has the right to charge you a reasonable fee for processing and complying with
your data access request.
Security and Storage
of Personal data
All personal data are stored in a secure place and/or system to the extent that any unauthorized access is
strictly prohibited.
Transfer and
Disclosure
Your personal data are kept confidential but, subject to the provisions of any applicable law, may be provided to:
- Employees and officers of Gammon;
- partners or affiliated, associated or subsidiary companies of Gammon;
- any agent, contractor or third party who provides administrative,
technology or other services to us, our partners or our affiliated, associated or subsidiary companies in the
specific countries or elsewhere and who has a duty of confidentiality to protect the confidentiality of your
personal data;
- any actual or proposed assignee, transferee, participant or sub-participant
of our rights or business; and/or
- any government department or other appropriate governmental or regulatory
authority.

We may from time to time update this PICS to ensure it is consistent with our future developments, industry trends
and/or any changes in legal or regulatory requirements. Subject to your rights at law, the prevailing terms of
this PICS shall apply. You should therefore check on a regular basis whether this PICS has changed and, if
appropriate, whether you also consent to the updated version.
